Our services and estimates

The Site describes the landscaping, hardscaping, property care and construction services we offer. Submitting an estimate request does not create a contract. Estimates are based on the information available at the time and on an on-site visit, and may change if site conditions, scope or material prices change.

Home improvement work is performed only under a separate written contract that sets out the scope, price, schedule and other terms, as required by New Jersey law. If anything in that contract conflicts with these Terms, the contract controls.

Using the Site

You agree to use the Site only for lawful purposes. You agree not to:

• Submit false information or requests on behalf of someone else without their permission
• Upload content that is unlawful, harmful or that you do not have the right to share
• Attempt to interfere with the Site’s security or operation

Content and photos

The text, design and project photographs on the Site belong to Benny's Landscaping & Construction and may not be copied or reused without our written permission. Photos you upload with an estimate request remain yours; you allow us to use them to evaluate and quote your project.

Reviews and third-party services

Customer reviews shown on the Site come from Google and reflect the opinions of individual customers. Links to Google, Instagram and other third-party services are provided for convenience and are governed by those services’ own terms.

Text messaging (SMS) program

Program name: Benny's Landscaping & Construction Text Messages. The program is run by Benny's Landscaping & Construction. You join it only by checking one or both optional boxes on our estimate form; neither box is checked for you, and neither is required to request an estimate. Consent is not a condition of purchase.

• Customer care messages (first box): updates about your estimate, appointment scheduling and reminders, service and project updates, and a request to review our work after the job.
• Offers and reminders (second box): occasional promotions and seasonal reminders, such as spring clean-up or snow removal sign-ups.
• Message frequency varies. Msg & data rates may apply.
• Reply STOP to any message to opt out. We will send one message confirming you are unsubscribed, and no more after that. Reply HELP for help.
• Support: call or text (908) 655-8284.
• Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information; mobile information is never shared with third parties or affiliates for marketing or promotional purposes.

Disclaimers

The Site and its content are provided “as is” for general information. We work to keep information accurate, but we do not guarantee that the Site will always be complete, current or error-free, or available without interruption.

Limitation of liability

To the fullest extent permitted by law, Benny's will not be liable for any indirect, incidental or consequential damages arising from your use of the Site. Nothing in these Terms limits any rights you have under a written contract with us or under consumer protection laws that cannot be waived.

Governing law

These Terms are governed by the laws of the State of New Jersey. Any dispute relating to the Site will be handled in the state or federal courts located in New Jersey.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they were last changed. Continued use of the Site means you accept the updated Terms.
